Every document an officer will look for, grouped in the order they are read. The ones marked refusal risk are where these applications actually fail — a complete file is not the same as a persuasive one.

Identity
Who is this person, and is the story consistent?Where files fail here: Names, dates or passport details that disagree across documents.
Generic application and background forms
Schedule A asks for an unbroken address, status and employment history. Gaps covering unauthorised work or overstay are what turn an H&C into a misrepresentation file.
Document checklist
These files are routinely returned for a missing signature or an unpaid fee before an officer ever reads the hardship narrative.

Check the bars before anything else
You cannot file within 12 months of a refugee claim being rejected, abandoned or withdrawn, and you cannot file a second H&C while one is pending. Two narrow exceptions to the 12-month bar: a life-threatening medical condition untreatable at home, and the best interests of a child under 18.

Supplementary information — humanitarian and compassionate considerations
This is the only form on which the case is actually made. A thin version of it, with the real story relegated to an unlabelled attachment, is the most common structural failure in these files.
Evidence of establishment in Canada
Employment letters, notices of assessment, leases, bank records, course records, community letters. Officers weigh whether the settlement was built during a period of authorised status.
Best interests of the child evidence
Birth certificates, school reports, custody orders, medical records, letters from teachers. A child has to be named and the concrete consequence spelled out — generic pleading gets no weight.
Hardship and country-condition evidence
Note the statutory trap: risk factors under sections 96 and 97 cannot be considered as such on an H&C, so they have to be framed as hardship instead.
Admissibility
Is there anything that disqualifies them?Where files fail here: An old charge left undisclosed because it “didn’t count”.
Understand what filing does not buy you
An H&C application does not stay a removal order. IRCC says so in terms: filing will not prevent or delay removal from Canada.
